Franchising is a form of distribution in which the franchisor gives the franchisee certain know-how and grants him various rights of use to trademarks, industrial property rights and copyrights so that the franchisee can use the goods, services and / or technologies concerned of the franchise concept. For this, the franchisee usually has to pay a one-off and / or ongoing franchise fee.

Many franchisees do not know that due to their particularly close and permanent integration into a franchise system, they are also entitled to special protective rights developed by case law. Particular mention should be made of the case law on the franchisor’s duty to provide information before the conclusion of the contract, the case law on the content control of general terms and conditions in franchise contracts and their immorality.
